Definition

A tendency to soften judgment or punishment by accounting for context, human limitation, and the possibility of repair.

Poles

Each HES element is a spectrum, not a category: the Low and High poles describe how it presents at its two extremes, while the Reference marks the typical, everyday middle. The poles map variation across the range — neither end is inherently better or worse.

Low Pole

Rigid sanctioning; little allowance for circumstance or learning.

High Pole

Balances justice with humanity; chooses measures that correct without needless harm.

Reference

Merciful to in-group, strict to out-group or perceived dangerous offenders.

Measure

Primary: Intensity — harshness of selected sanction for the same offense under controlled conditions.

Measuring Methods

Standardized offense cases → sanction choices (punitive vs restorative vs warning) with severity controls.

Empirical Anchor

Mercy / clemency; moral virtue tradition; restorative justice orientation.

Notes

Mercy is not indiscriminate forgiveness; it is calibrated sanctioning.
